These Terms & Conditions (“Terms”) govern membership and participation in the Creators Collective Club (“the Club”), operated by Bayls & Ko (“we”, “us”, or “our”).

By submitting an application, joining the Club, accessing its content, attending events, or making any payment, you agree to be bound by these Terms.

1. About the Creators Collective Club

The Creators Collective Club is a community-based platform designed to support content creators through education, resources, networking, events, brand opportunities, and shared content.

Membership benefits may change or evolve at our discretion.

2. Membership Eligibility & Application Review

• Membership is subject to an application and review process

• Submission of an application does not guarantee acceptance

• We reserve the right to approve or decline applications at our discretion

Refund Policy Related to Applications

• Refunds are only issued if an applicant is not successful after the application review process has been completed

• Once an application has been approved and access granted, no refunds will be issued

• By submitting payment, you acknowledge and accept this refund policy

3. Membership Fees & Payments

• Membership fees (if applicable) are communicated at the time of application

• All payments are subject to the refund policy outlined above

• By making any payment, you confirm acceptance of these Terms

• Fees may change with reasonable notice

4. Use of Club Content & Materials

All content provided within the Club — including educational materials, templates, videos, workshops, graphics, and resources — remains the intellectual property of Bayls & Ko or its licensors.

Members may use materials for personal and educational purposes only and may not share, reproduce, resell, or distribute content externally.

5. Member-Generated Content & Promotional Use

By submitting, posting, or sharing content within the Club, you confirm that you own the rights to the content or have permission to share it.

You grant Bayls & Ko a non-exclusive, royalty-free licence to use, share, repost, and display such content for:

• Club-related activities

• Marketing and promotional purposes

• Display on our website and social media platforms

Requests to opt out of promotional use must be made in writing.

6. Collaborations, Brand Products & Personal Responsibility

The Club may facilitate access to brand collaborations, gifted products, events, or experiences.

• Participation in brand collaborations is voluntary

• Bayls & Ko does not manufacture, supply, or control brand products

• Any use of gifted or sponsored products is done at your own risk

Bayls & Ko accepts no responsibility or liability for any injury, reaction, loss, damage, or harm arising from the use of brand products or participation in collaborations.

Members are responsible for ensuring products are suitable for personal use and for following all safety instructions.

7. Community Conduct

Members agree to behave respectfully and professionally. Harassment, discrimination, misuse of content, or disruptive behaviour will not be tolerated and may result in removal without refund.

8. No Guarantees

We do not guarantee:

• Brand deals, income, or opportunities

• Audience growth or engagement

• Specific outcomes or success

Participation in the Club is for educational and networking purposes.

9. Termination of Membership

We reserve the right to suspend or terminate membership if:

• These Terms are breached

• Misuse of Club content occurs

• Behaviour is harmful to the community

Termination may occur without refund where applicable.

10. Limitation of Liability

To the fullest extent permitted by South African law:

• Participation in the Club is at your own risk

• Bayls & Ko is not liable for indirect or consequential damages

• Liability is limited to fees paid, if any

11. POPIA & Personal Information

Personal information is processed in accordance with the Protection of Personal Information Act (POPIA). Please refer to our Privacy Policy for full details.

12. Changes to These Terms

We reserve the right to update these Terms at any time. Continued participation constitutes acceptance of updated Terms.

13. Governing Law

These Terms are governed by the laws of the Republic of South Africa.
